Wedding and Occasion Cake Order Terms and Conditions

 

Prices

You agree to pay Chelsea Buns Cake Design the price as quoted on your confirmation booking form, emails and/or invoice.

Bookings and Deposits

All Orders and Booking Dates are only secured with a non-refundable booking fee. Quotations are valid for 28 days from date of issue. Unfortunately, due to the high demand for bookings, it is not possible to reserve you day prior to the payment of the deposit.

Consultations and Sample Boxes

All clients will be offered one complimentary design consultation (face to face or video call) to discuss your wedding cake in detail. Consultation is only available to clients that have paid a deposit/booking fee payment. Additional face to face meetings will be chargeable. All sample boxes  will be chargeable and can be ordered through my website. Clients wishing to have a naked/semi-naked or very minimalist cake design (i.e plain iced with fresh flowers) may not require a full design consultation and so details for this style of cake will be discussed via email and a face to face or video consultation may not be offered.

Cake Design Changes

Any changes made to your cake order must be done a minimum of 6 weeks prior to your wedding date. Any changes made may incur additional costs. Additions to the agreed quotation are chargeable, dependant on time involved and cost of materials. Any changes requested less than 4 weeks before the cake is required will be met where possible but cannot be guaranteed.

Payments

Your initial booking fee is required to secure your booking and is non-refundable under any circumstances. The final balance is due no later than 6 weeks prior to the cake delivery date as specified on your confirmation booking form. Failure to make payment of the remaining balance may result in your order being cancelled. While every effort will be made to keep your order on track, late payment of the final balance may result in Chelsea Buns being unable to complete your cake by the required date. Late or non-payment

Late or non-payment could result in loss of your booking date. In the event of a late or non- payment, the order will not proceed until alternative funding has been agreed and payment made in full. In these circumstances completion of the order on the required date cannot be guaranteed and becomes subject to availability. Every effort will be make to complete your order by the date initially agreed, however, Chelsea Buns cannot be held responsible for delays to completed order should this be due to late or non-payment.

Delivery/Collection

Unless otherwise requested, wedding cakes will be delivered and set up at the agreed venue on the required date as stated on the confirmation booking form. The cost for delivery and set up will be included within your confirmation booking form. If we cannot deliver the cake because there is no one to receive it or if the venue details are incorrect the cake will held for a maximum of 24 hours at my business address. Should the cake not be collected or is unable to be delivered after this period, Chelsea Buns has the right to resell the cake. Should you request to collect your cake, the cake must be collected at an agreed date and time. Chelsea Buns cannot take any responsibility for any damage sustained to the cake during transport, delivery and subsequent set up at the venue if collected. The cake becomes the sole responsibility of the customer once it has left my premises. For wedding cakes, set up at the venue will occur at an agreed time with the venue. The cake will be set up in line with the details on the booking form and in the final location at the venue. The cake will be photographed in situ before we leave the venue. Any damage sustained to the cake after this time is the responsibility of the venue and not Chelsea Buns. Chelsea Buns are not responsible for any repairs as a result of damage sustained at the venue or as a result of failure to follow instructions/advice we may give in respect of storage or setting up or further transportation of the cake.

Cancellations

Cancellation of your wedding cake 12 weeks or more prior to your wedding date or requested date, will result in the booking fee being retained. The initial booking fee is non-refundable or transferable in any circumstances. Cancellations made 5-11 weeks before the agreed date, 50% of the remaining balance is due to cover the cost of any works already undertaken to create the unique elements of your cake and to cover the cost of any special items or supplies that have been purchased to complete your cake. Cancellations made 4 weeks or less before the agreed date will result in the full balance being retained. If the balance has not yet been paid, payment in full will be required. All cancellations must be made in writing to : info@chelseabuns.co.uk or Chelsea Buns Cake Design 6 Cuthbert Close, Tovil, Maidstone, ME15 6AY. Verbal phone cancellations will not be binding. If you choose to cancel your booking, unfortunately your booking fee or any balance paid and retained cannot be transferred to another booking or date under any circumstances.

Change of Wedding Dates

If for any reason you have to re-arrange the date of your wedding, we will try our best to accommodate these changes without any additional charges provided sufficient notice is given. If we are fully booked on your new wedding date and cannot provide the wedding cake, it will not be possible to refund your deposit. The limiting factor with any cake provision is usually the cake set-up. As a compromise it may be possible to provide you with a cake prior to your wedding date, but under these circumstances it will become your responsibility to collect, deliver and set up the cake at the venue. If you cancel your wedding cake order with us after requesting a date change, no refunds will be made to you (the client) under any circumstances.

Stand/Knife Hire

Chelsea Buns have a range of cake stands for hire. All stands are hirable for a 3 day period (including your wedding/event date) and are charged at £25-75 per stand depending on the item. The hirer is responsible for returning the hired equipment to Chelsea Buns within the agreed timescales. Any damages or non return of the hired items will result in being invoiced for a full replacement of the hired item (plus any P&P costs). 

Allergens

Any special request or allergens (such as “no nuts” ) will be met wherever possible. Your cake will be made in a premise which handles nuts, dairy, gluten, and soy as such, no absolute allergen free guarantees can be given to any cake order. Allergy information will be provided with all orders. It is the responsibility of the client to advise Chelsea Buns of all allergens at the time of booking.

Colour Matching

Whilst every effort is made to match colours for icing, ribbon, flowers and other decorations, it is not always possible to match them exactly. Colours will look different in different light (natural, artificial and time of day), on different devises and are also subject to personal interpretation. Chelsea Buns colour interpretation is final.

Naked, Semi-Naked and Buttercream Cakes

Whilst every effort is made to make your naked cake/semi naked cake as fresh and moist as possible, over time and depending upon the weather and warmth at your venue, your cake may start to become dry. Chelsea Buns take no responsibility for this and will provide the best moist cake possible. Due to Food Hygiene regulations it is not possible to use fresh cream or any cream cheese based fillings in these cakes, buttercream or frosting will be used.

Buttercream cakes – If you choose to have a buttercream cake (especially during the summer months) please note that Chelsea Buns take no responsibility for the adverse effects that the weather may have on this type of cake. Hot weather can cause melting and/or damage to buttercream/naked and semi-naked style cakes. Chelsea Buns will do everything possible to reduce the risk factors when you choose a buttercream style cake (i.e set up as late as possible, place the cake in the coolest place in your venue, discuss risks with wedding coordinator/team etc).

Fresh Flowers

Flowers provided by third parties should be provided with the ends sealed ready for insertion into the cake using food safe flower picks or for placing on the cake. Chelsea Buns reserves the right not to use any flowers that are deemed unsuitable or those which have not been prepared appropriately. Some flowers are deemed poisonous. Chelsea Buns takes no responsibility for the choice of flowers you wish to add to your cake. Please ensure the flowers chosen are safe for food contact and prepared correctly for use. Fresh flowers will be required to be available at the time of the cake delivery. If they are not available, Chelsea Buns will be unable to dress your cake.

Cake Toppers and Cake Stands

We accept no liability whatsoever for toppers provided by the client. Where a client has supplied or wishes to supply a cake stand or any accessories for the wedding cake, Chelsea Buns will set up the cake as per the instructions detailed within the confirmation booking form. Chelsea Buns cannot be held responsible for any issues with a stand that has not been seen or checked for suitability before set up of the cake. Chelsea Buns reserve the right not to use any cake stand supplied by the client or the venue that we feel will not support the cake. In this event we will place the cake directly on the table. Every effort will be made to adhere to the set up instructions as detailed within the confirmation booking form however, in circumstances where this is not appropriate, Chelsea Buns decision on set up will be final. Items required for use or to be set up with the cake must be at the venue prior to delivery and set up of the cake.

Complaints

In the highly unlikely event you have cause to complain, no cake must be eaten. You (or the venue) must call us immediately and the cake must be retained (await instructions from us). The cake will be required to be returned to Chelsea Buns premises for inspection within 24 hours of collection/delivery. If the cake is eaten, either wholly or partly (i.e. more than a couple of mouthfuls) we cannot accept any complaint. Any possible refund will be determined by the manager only if they concur it was the fault on part of Chelsea Buns. Complaints made 7 days or more after the cake was collected/delivered will not be dealt with as we were not provided with the opportunity to try and correct any issues or inspect the cake. All refunds are made at the discretion of the manager. No refunds will be given on differences of artistic opinion with regards to design or colour tones. If you have any concerns or complaints about your order we ask that you contact us directly as soon as possible via email, outlining your issues as full as possible so that we can deal with the issues as quickly as possible. Any complaint posted in public forums will not be dealt with. Any attacks or unwarranted comments made in any public forums will be seen as libel and we will endeavour to seek legal advice and claim for damages.

Photography

We reserve the rights to photograph your cake order whilst on our premises or during delivery for our own reference, use on our social media, websites, publication or may be printed for our portfolio. Any images provided to us by you or your photographer will also fall under the rights as above.

Weather / Traffic

Should we be physically unable to deliver your cake in circumstances such as and not limited to: snow, flood, Operation Stack, traffic jams & road closures, hurricane, accidents, we will inform you as soon as possible. We will explore all other roads in order to get you your cake but accept no liability for our inability to deliver the cake or lateness under circumstances that are unforeseen or out of our control.

Chelsea Buns take no responsibility for any adverse effects the weather has on your cake once we have set up and left the venue. Chelsea Buns will do everything possible to reduce risk factors during hot/cold weather to ensure your cake remains perfect, however, factors such as weather are out of our control so we cannot be held liable for the weather.

Storage of your Wedding Cake after delivery
Chelsea Buns recommends that your cake be eaten within a day or two of your wedding, if it has been wrapped well and stored in a sensible way. However, Chelsea Buns takes no responsibility for how you store the cake after your wedding or for the condition of the cake going forward.

 

COVID-19

Under normal circumstances, all deposits/booking fees are non-refundable under any circumstances as when a deposit is paid your date is secured in my diary which means I restrict the other bookings I take on/around your wedding date. Your deposit payment also helps to cover any costs/time spent for admin, consultation etc in the run up to your big day. However, if your wedding is specifically effected by COVID-19 I will do all I can to help and make things as easy as possible for you.
In the event that you postpone your wedding, your booking will be transferred to your new date along with your paid deposit. No further payment would be required to secure your new date, everything would simply move across to your new date.
If your new date falls within the calendar year immediately after your original date, there will be no price changes to your booking. 
In the event that you move your wedding beyond the year immediately after your original date, your booking would be subject to my standard yearly price increase – this is a minimal increase that just helps to cover the year on year increased cost of ingredients.
In the event that you cancel your booking completely any deposit refund offered would be discretionary and dependant on the amount of work already complete on your booking (including but not limited to reserving your date (meaning I may turn away other work on that date), time spent on administration, correspondence, consultation, designs and cost of products purchased specifically for your order). Any decision to refund a deposit in full or part is made on a booking by booking basis and cannot be guaranteed. Any deposit/booking fee payment made cannot, under any circumstances, be transferred to another cake or booking. The deposit/booking fee paid, reserves a specific date with me and covers any work carried out on that booking alone and cannot be used towards another booking.
If I am not available for your new wedding date, a deposit refund will be offered minus reasonable costs for my time and works already done on your booking (including but not limited to time spent on administration, correspondence, consultation, designs and cost of products purchased specifically for your order)
Please note, Covid terms and conditions are only in place for those weddings that are directly effected but COVID restrictions. Following the roadmap that was released in February 2021, if your wedding falls after 21st June 2021 (as currently advised as the date from which weddings can go ahead “as normal”) your wedding booking will fall under my standard terms and conditions. Should the government guidelines change, I will alter my COVID terms accordingly.

Cakeaway and Wedding Cake Sample Box Collections

All orders placed for click and collection will be available for collection on your selected collection day and will need to be collected between 2pm-4pm on your chosen day. We cannot offer collections outside of the allocated times and days available. Chelsea Buns is not responsible if you are late to collect and we are closed. All items are baked fresh for your specified date.
If you do not collect your order or collect your order days later and your goods are not as fresh, Chelsea Buns are not liable for any refund or exchange as this is not the fault of Chelsea Buns Cake Design.Any uncollected orders will be kept for no longer than 72 hours before being disposed of. No refund, exchange or replacement will be offered for any uncollected orders.
You are agreeing to these terms when placing your order for collection.

 

Postal Orders

All of our baked goods, other than cupcakes and drip cakes can be posted via Royal Mail to your doorstep.
All Cakeaway products and Wedding Cake Sample boxes will be sent out for delivery no later than 3 working days after you place your order. Please note Postal products will not be dispatched on a Friday, Saturday or Sunday to limit the amount of time your order sits at a mail depot.
All postal orders will be sent via Royal Mail 24 Tracked. Once your order has been sent you will receive tracking information direct from Royal Mail and your order will be out of my hands.
Chelsea Buns Cake Design can not guarantee the time or date of your delivery being made and we do not use a guaranteed next day service so please be patient especially during the current Covid-19 situation as some parcels are being a little slower getting to their destination.
All items are wrapped and packaged in such a way to make sure they arrive as fresh as possible to you.
Chelsea Buns Cake Design is not responsible for any lost, missing or damaged parcels and will be unable to offer a refund, replacement or gift cards to cover these parcels.
You are agreeing to these terms when placing your order for postal delivery.
